ICE officials provided a copy of a new policy memo (http://www.chron.com/disp/story.mpl/metropolitan/7169978.html)dated Aug. 20 that instructs government attorneys to review the court cases of people with pending applications to adjust status based on their relation to a U.S. citizen. ICE estimates in the memo that the effort could affect up to 17,000 cases.
The Department of Homeland Security is systematically reviewing thousands of pending immigration cases and moving to dismiss those filed against suspected illegal immigrants who have no serious criminal records, according to several sources familiar with the efforts.
Opponents of illegal immigration were critical of the dismissals.
"They've made clear that they have no interest in enforcing immigration laws against people who are not convicted criminals," said Mark Krikorian, executive director of the Center for Immigration Studies, which advocates for strict controls.
In a June 30 memo, ICE Assistant Secretary John Morton outlined the agency's priorities, saying it had the capacity to remove about 400,000 illegal immigrants annually � about 4 percent of the estimated illegal immigrant population in the country. The memo outlines priorities for the detention and removal system, putting criminals and threats to national security at the top of the list.

My H1 Extension approved from Sept'2010 - Dec 2012. LCA shows same dates and the salary shown is $5500 PM ($66000 P.A)
However recently, i noticed that i am receiving $5373(instead of $5500) per month since Sept'2010 till date.
I informed to my employer and he is willing to increase the pay from March.
Is it possible to correct it from March payroll.
Please advise.

The employer should correct it from March and pay the 6 months difference as bonus. At end of year your salary should be at least equal to LCA.

I went to graduate school in the US, (majored in Architecture) and was on an F1 visa from the period 2006-2009.I graduated in Aug 2008 and applied for an H1 through a consultancy firm.The petition for an H1 visa was approved, but I decided to return back home anyway and came home in 2009.
2 weeks ago, I visited the States for a week for a conference on a B1/B2 visa. I eventually want to return to the States and work there and therefore, need advice in this regard...
Given that my petition for an H1 has been approved, will the company that offers me employment have to reapply for an H1 for me?Or can the H1 be transferred from the Consultant company(that got me the H1), to the new company easily?!
Any help in this matter will be highly appreciated!

Why not microsoft? The rest of high tech industry will not survive if they can't move their 60% of operations outside of USA. Bone headed congress will continue to come up with legislation that encourage illegal immigration and discourage legal immigration. Sounds like 19th century for UK, 20th century for USA and 21st century for China and India. Dollar declines and what is the use of GC? I am thinking of going back where the growth is.

I need help on my I485 pending case:
When I was a PHD student I filled NIW (national interest waiver) and got my I-140 approval (priority date is 6/22/2006). Now I am working for a Telecommunication company.
My NIW I-140 form stated my job is:
SOC Code: 17-2112
Nontechnical description of job: Operations research and logistics with optimization and numerical analysis.
In my NIW cover letter, I stated my contribution in airline industry with the operations research and optimization knowledge. My current work is still related to the operations research and logistics but my contribution is different now. Does that mean I am not in the same research/work field? Some attorney said my I-485 will most probably be denied because I am not benefit to airline industry now. Is this true?
What is the definition of the same/similar field? I thought I should be safe as long as I continue to work on OR and logistics related work, even if my work on different project or for different companies.
When USCIS process I-485, they will look at the job description on I-140 form or the contribution in cover letter?
An attorney suggested me to apply a PERM as a backup to keep the existing priority date (6/22/06), in case my NIW-based 485 case has any issue.

Very legitimate question- don't know if anyone here will have a good answer (I hope so) but I hope you get your problem solved. I would advise a consultation with a good attorney, this is a very important matter for you. Some attorney's will answer an initial question free on the web- gives you some preliminary info.

My attorney has submitted the documents for I140/485 concurrent filing. UPS has messed up and they lost my documents.It contains original documents for applying I140.
I am wondering if there is any chance that I can send photocopy of documents to USCIS explaining them the situation as I do not want to miss the chance of deadline Aug 17th. Could anyone please suggest me? Did anyone experience the same situation before.

I don't know the answer....but I suggest community to NOT to use UPS...since I also lost my documents couple of times (while sending to attorney). I stopped using it

you should get receipt within a week, so there is not much difference in time.
You can join new co as soon as USCIS recieves your petition, but most people play safe and wait until the receipt notice arrives.

I had a RFE against my I-485 in last week of Nov 07. It was for medical exam, doc forgot to check one box :(
Now the RFE has been replied to and USCIS should hopefully have no further questions on my application. But now the issue is retrogression of EB2 India back to Jan 02 (while I am Jun 03). So does that mean though my application could be cleared by the immigration officer, it will still be put back on shelf because of the retrogression in Dec 07 ?

Just a question.......... I just got my receipts for my 485. When I checked the receipt number on uscis it says that an approval notice for the ead was sent out 2 days ago. Any idea how long it takes to actually get the card??

Could one by considered agricultural worker if they are in landscaping business ? what about in agricultural sales.
We are about to see creation of huge black market for documents claiming someone is farmer if this rule is passed.
Can one be illegally working as Ag worker while on H1 ? :)
